Federal Signal “DID NOT OBJECT” and Admitted that Patents are Valid and Infringed, announces Neology

SAN DIEGO, July 30, 2012 /PRNewswire/ — On June 25, 2012, Neology, Inc. announced that U.S. Magistrate Judge Mary Pat Thynge of the Federal District Court in Delaware had issued a Report and Recommendation (“Report”) with respect to Neology’s request for a preliminary injunction in connection with Neology’s patent infringement case versus Federal Signal Corporation, et al. (“FS”) in which Judge Thynge recommended that Neology’s patents be found valid and infringed by FS.

The time to object to this recommendation has now passed and FS did not object to the finding of validity and infringement. FS also admitted that based on Judge Thynge’s claim construction that patents are valid and infringed.  This should allow Neology to move for a quick resolution on these issues. Neology will now move forward to seek a permanent injunction against FS’ infringing products and to recover substantial and material damages suffered from FS’ infringement of Neology intellectual property.
